The Prosecutor's Office has verified that there is no criminal procedure opened for these events in Australia , therefore, since these events occurred abroad and the perpetrator was a Spanish national, the Central Investigative Courts are competent (articles 23.2 and 65.1 LOPJ). For crimes committed abroad to be prosecuted, as established in article 23.2 of the LOPJ, the act must be punishable in the place of execution , the Ministry must have filed a complaint before the Spanish courts and the offender must not have be acquitted , pardoned or punished abroad.

Article 191 of the Penal Code establishes that to proceed with the crimes of assault, harassment or sexual abuse (the latter no longer exist) the complaint of the aggrieved person will be required , which already exists in this case.
